Trade Customers Terms and conditions affective from 9-1-2012
As a wholesale supplier, all of our sales are made on a business to
business basis.
These terms and conditions apply to the use of the websites and
ordering for Creativity-Cards and Highland Pottery By accessing this
website and/or placing an order, you agree to be bound by these
terms and conditions.
Creativity is here to hopefully supply something you require at a
good price saving you money and also making a profit, for your
business. We hope you will be satisfied, with the products and
service. These terms and conditions are here for you and our
protection and to help keep the costs down for everyone. If you have
any suggestions or comments please contact us using e-mail or
Telephone. If you do not agree to be bound by these terms and
conditions do not place any orders. Whilst every effort as been made
to accurately reproduce the colours of the photo prints, variation
in both user settings and monitors may cause fluctuation for which
Creativity cannot be held responsible.
Privacy Policy: Creativity do not disclose buyers' information to
other parties. The information is used to fulfill customer orders and
Only disclose information to third-parties for goods delivery
purposes or insurance and to process Returns from customers.

distribute or use videos, photographs, designs, logos, and other
materials without the express permission of William Forrest

You are required to get permission and arrange a Contract and you
have to abide by the relevant copyright laws that apply in the UK.
You must not infringe W Forrest or Creativity rights, (an example
would be using any part of a Photo or sound or video file)
• All products ordered from Creativity will be subject to these
terms and conditions. By entering into a transaction either using
this website directly or ordering via email or post or fax or
telephone you agree to these terms and conditions.
Terms:
• These Terms and conditions apply to all contracts for the sale of
goods by us to your business and shall be deemed to supersede and
exclude all other terms and conditions including any which you may
seek to apply under any purchase order or similar document and they
form an integral part of the Contract between us.
• No variation or addition to these terms and conditions shall be
effective unless agreed in writing by W Forrest.
• Our employees or agents are not authorized to make any
representations concerning goods on our behalf unless such
representations are confirmed in writing by our authorized officer.
• No contract for the sale of the goods shall exist until either you
accept our quotation in writing or E-mail or the goods are
dispatched, whichever is the sooner.
• Once you have accepted delivery of the goods, your acceptance of
these conditions will be deemed to have occurred.
• Should you be in breach of your obligations under these terms, you
are to indemnify us in full against all liabilities we may incur.
Ordering
• You are deemed to place an order with us by ordering by E-mail,
Fax, Post or Telephone. As part of our process you will be given the
opportunity to check your order and to correct any errors by e-mail
or fax. We will send you an order acknowledgement, detailing the
products you have ordered, if you require one.
• You warrant to us that all information which you are required to
provide when ordering Goods is accurate and complete in all respects
at the time of the order and that this information relates to
you/the person or business placing the order and not to any third
party.
• Any error in any ordering process due to technical or other
reasons beyond our control entitles us not to treat the order as
being binding on us.
All new orders are by pro forma. All payments for Goods and for the
cost of packaging and delivery must be made before the Goods are
delivered.
• We do not supply goods on a sale or return basis.
• In the case of Goods which are made and supplied to your
specification or which have been personalised for you, you will not
have the right to cancel the Contract.
• Until all amounts due to us have a been paid, all goods supplied
by us remain our property.
• You have no right to re-sell any Goods until payment has been
received in full by us.
• You may not sell these goods if we notify you in writing that this
right has been revoked by us or if you have become insolvent. You
must then grant us permission to enter any premises where the goods
may be stored and allow us to remove them.
• You must notify us immediately in writing should you become
insolvent.
• We have the right to take legal proceedings to recover the price
of the goods supplied should you not pay us by the due date.
• Our acceptance of an order takes place when we dispatch the order.
When we dispatch the order the purchase contract will be made even
if your payment has been processed immediately, unless we have
notified you that we do not accept your order or you have cancelled
your order
Prices
• Prices include VAT at this time.
• The price is excludes delivery charges.
• Our minimum order is £58.50p.
• All orders over £100 are delivered free of charge, orders below
this figure are charged £6.
• We supply our cards in multiples of six.
• We don't supply spinner or displays to our customers.
• Pack Promotions as priced at time.
Description Of Goods:
• We take care to ensure that the description and specification of
our products are correct at the time of going to press. However,
while the colour reproduction of the products is a close
representation, we cannot accept any responsibility for any
variation in colour caused by the browser software or computer
system used by you.
• We reserve the right for cards to use alternative envelope colours
and packaging materials at any time.
Payment:
• We can take payments by cards (Telephone) or by Cheque.
• We may agree a credit account with you, in which case payment is
due no later than 30 days after the invoice date. • • The terms of a
credit account may be varied at any time.
• Prices are in UK Pounds and credit card transactions are billed in
Pounds Sterling.
• All orders must be paid in full together shipping charges and VAT
where applicable before shipping. If you don't have a trade account,
• All Invoices Have to be paid within 30 days of the Invoice Date
Creativity will not accept Late Payment of Any Type
• Should you pay late, we reserve the right to charge you interest
at the rate set by The Late Payment of Commercial Debts (Interest)
Act 1998, to accrue from the invoice date.
Creativity charges 5% on unpaid Invoices after 30 Days.
• Any additional costs incurred by us in collecting a late payment,
including administrative and other costs incurred in taking legal
proceedings, will be charged to you.
• All published prices are subject to change at any time without
notice.
Delivery: We deliver your order, as, soon as possible .
• We will give you an estimated delivery date for the Goods but no
times or dates provided by us are guaranteed. We will normally send
your order to you in 5 business days if in stock. International
orders are generally received in under 21 days. If your item is not
in stock, it will Not be back ordered. You will have to reorder at a
later time if available.
• You will always have the option to cancel your order or change the
order up to shipping.
• Orders are normally dispatched by post with signature on delivery
with Royal Mail. Any delivery time stated in any documentation is an
estimate only.
• If any order is split for delivery, each delivery constitutes a
separate contract.
• Should there be any unreasonable delay in delivery, you may cancel
the contract but only prior to despatch from creativity.
• We decide on the method of delivery either by post, courier or
otherwise.
• Delivery charges are passed on at cost, for goods.
• The cost of packaging and postage/carriage is shown separately and
(in the case of special or overseas orders) will be quoted by us on
request and payable separately from the price of the Goods.
• If you refuse to accept delivery we reserve the right to recharge
our delivery costs to you.
• Royal Mail Track and Trace Service
When you pay Creativity for your order we give a posting date. If
you do not receive your order within 5 days after that date, It is
your responsibility to contact us and we will supply the Reference
Number for the Royal Mail Track and Trace Service at there Web Site
www.royalmail.com . Where you can see proof of post and delivery
date on at least one occasion. This service starts two working days
after posting, for first class and four working days for second
class and it is free.
• We will not have any responsibility for any damage which occurs to
the Goods after delivery.
Returns and Refunds Policy:
• You must notify us promptly and in any event of missing, damaged,
shortages or incorrect items or shortages should be reported to us
within 3 days of receipt of the order.
• In those circumstances, you must also keep all packaging as this
may be required when making a claim.
• Faulty items will be refunded in full including all postage costs.
Undelivered orders: Returned orders to creativity:
• If an order is undelivered for any reason other than, it was
damaged by the Royal Mail, lost by the Royal Mail or there was no
attempt to deliver by the royal mail on at least one occasion. The
postage will have to be paid for again, to send the order a second
time, as our prices don’t include or cover these extra costs.
Example; If the Royal Mail try to deliver the order and the
recipient is not at the delivery address. In this case the Royal
Mail usually leaves a card but not always, for you, to collect the
parcel from the local post office. It is your responsibility to
collect it from there. You must take reasonable care of all Goods in
your possession
Change of mind and returns:
• The intent to cancel a order should be reported to us as soon as
possible before the sending of a order.
• Returning a order sent : If you order the wrong goods or return
goods you decide you do not wont or do not require You have 7
working days of receiving the order to send it back after that you
it is deemed, that you, have excepted the order. Then all the
delivery costs will be borne by you the customer as our prices don’t
include or cover these extra costs.
• Any order returned to us need to be returned via a signed for
service. Upon receipt, We will refund the purchase price to you
within 5 days. We will issue a refund minus the original carriage
charge plus a restocking fee of 2% of the total order.
• We reserve the right to arrange collection, in which case you will
be responsible for collection charges.
• No refunds will be give if you have used the goods or damaged the
goods.
• All returned goods must be unused and in the original packing and
in perfect condition with all manufacturers tags and returned to us,
in appropriate packaging to avoid damage, upon receipt at our
warehouse within 14 days.
• A refund of some delivery costs will be given if for instance the
incorrect goods, colour, size, or faulty goods are sent.
• Any dispute over goods, costs, prices, charges, deliveries, damage
to goods will be referred by creativity to Consumer Protection or
Trading Standards or Citizens Advice Bureaux for a decision which we
will abide by. Please contact any of these bodies for more
information on what your rights are.
Force Majeure
• If due to circumstances beyond our control we are unable to supply
you or the cost of supplying you would be deemed unreasonable, we
may cancel your order without liability.
• These circumstances may include accident, explosion, fire,
transport delays, strike and acts of God.
• All complaints will be acknowledged within 5 working days. We will
endeavour to resolve any complaints within 14 days and keep you
informed during the resolution process.
Amendments to the terms and conditions
• Creativity reserves the right to change or alter these terms and
conditions, prices, related costs, products, sizes and
specifications at any time without notice or prior warning.
• All Goods remain the property of Creativity until paid in Full.
• Creativity warrants that all goods promoted for sale on this
website are of satisfactory quality and meet any description of them
on this website. In all other respects and to the maximum extent
permissible, Creativity makes no other warranties or promises about
the goods and any implied warranties are excluded.
• None of these terms and conditions are intended to be unfair terms
to the consumer or over protective of the supplier but fair to both
parties. If you do not agree to be bound by these terms and
conditions do not place any order.
• Links from this site to other sites are provided for information
and no liability can be accepted for their content or accuracy. The
provision of a link does not signify or imply an endorsement of any
kind by Creativity-Cards or Highland Pottery for the websites. We
have no responsibility for the content of the linked websites.
• Creativity-Cards or Highland Pottery will not be liable for loss
of any kind arising from the use of this site. All material on this
site is intended to be reviewed in its entirety, including any
disclaimers, restrictions, disclosures and copyright notices.
• Entire Agreement: These Terms govern our relationship with you and
in accepting them, you confirm that no other arrangement, agreement
or representation applies.
• Nothing in these terms and conditions shall exclude or limit your
liability for fraud or misrepresentation or any liability owed to
creativity costs payments or other debt.
• You agree to indemnify us fully, defend and hold us, harmless from
and against all claims, liability, damages, losses, costs (including
reasonable legal fees) arising out of any breach of the terms and
conditions by you, or your use of our Websites.
